1. Introduction

Welcome to GovConSoftwareHub, owned and operated by SoftServe Software LLC (we, our, us). These Terms of Service (Terms) govern your use of our website and services (Services). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our Services.

2. Use of Services

You must follow any policies made available to you within the Services. Do not misuse our Services. For example, do not interfere with our Services or try to access them using a method other than the interface and the instructions that we provide. You may use our Services only as permitted by law. We may suspend or stop providing our Services to you if you do not comply with our Terms or policies or if we are investigating suspected misconduct.

3. Your Account

You may need a GovConSoftwareHub account in order to use some of our Services. You are responsible for protecting your account by keeping your password confidential. You are responsible for the activity that happens on or through your account. Try not to reuse your GovConSoftwareHub account password on third-party applications.

4. Privacy

Our Privacy Policy explains how we treat your personal data and protect your privacy when you use our Services. By using our Services, you agree that we can use such data in accordance with our Privacy Policy.

FOR BRANDS USER REGISTRATION You may be required to register to use the Services. You agree to keep your password confidential and will be responsible for all use of your account and password. We reserve the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that such a username is inappropriate, obscene, or otherwise objectionable. PURCHASES AND PAYMENT We accept the following forms of payment: Visa Mastercard American Express Discover You agree to provide current, complete, and accurate purchase and account information for all purchases made via GrailX. You further agree to promptly update account and payment information, including email address, payment method, and payment card expiration date, so that we can complete your transactions and contact you as need. Sales tax will be added to the price of purchases as deemed required by us. We may change prices at any time. All payments shall be in US dollars. You agree to pay all charges at the prices then in effect for your purchases and any applicable shipping fees, and you authorize us to charge your chosen payment provider for any such amounts upon placing your order. We reserve the right to correct any errors or mistakes in pricing, even if we have already requested or received payment. We reserve the right to refuse any order placed through GrailX. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. These restrictions may include orders placed by or under the same customer account, the same payment method, and/or orders that use the same billing or shipping address. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers, or distributors. SUBSCRIPTIONS Billing and Renewal Your subscription will continue and automatically renew unless canceled. You consent to our charging your payment method on a recurring basis without requiring your prior approval for each recurring charge, until such time as you can cancel the applicable order. The length of your billing cycle is monthly Cancellation All purchases are non-refundable. You can cancel your subscription at any time by logging into your account. Your cancelation will take effect at the end of the current paid term. 5. Modifications

We are constantly changing and improving our Services. We may add or remove functionalities or features, and we may suspend or stop a Service altogether. You can stop using our Services at any time. We may also stop providing Services to you, or add or create new limits to our Services at any time.

6. Liability for our Services

When permitted by law, SoftServe Software LLC, and SoftServe Software LLCs suppliers and distributors, will not be responsible for lost profits, revenues, or data, financial losses, or indirect, special, consequential, exemplary, or punitive damages.

7. About these Terms

We may modify these Terms or any additional terms that apply to a Service to, for example, reflect changes to the law or changes to our Services. You should look at the Terms regularly. We’ll post notice of modifications to these Terms on this page. Changes will not apply retroactively and will become effective no sooner than fourteen days after they are posted. However, changes addressing new functions for a Service or changes made for legal reasons will be effective immediately.

If there is a conflict between these Terms and the additional terms, the additional terms will control for that conflict.

These Terms control the relationship between SoftServe Software LLC and you. They do not create any third-party beneficiary rights.

If you do not comply with these Terms, and we don’t take action right away, this doesn’t mean that we are giving up any rights that we may have (such as taking action in the future).

If it turns out that a particular term is not enforceable, this will not affect any other terms.

The laws of California, U.S.A., excluding California’s conflict of laws rules, will apply to any disputes arising out of or relating to these terms or the Services. All claims arising out of or relating to these terms or the Services will be litigated exclusively in the federal or state courts of Broward County, Florida, USA, and you and SoftServe Software LLC consent to personal jurisdiction in those courts.
